Amanita Muscaria, Explained
Amanita muscaria is the red-and-white fly agaric mushroom. It contains muscimol and ibotenic acid, not psilocybin. That distinction is the reason it is unscheduled under federal law and lawfully sold in 49 states, while psilocybin mushrooms are not.

Amanita muscaria is probably the most recognisable mushroom in the world — the red cap with white flecks that appears in illustrations far more often than it appears in conversations about what is actually in it.
Its principal compounds are muscimol and ibotenic acid. Neither is listed under the federal Controlled Substances Act, and Amanita muscaria does not appear on the DEA list of drugs of concern. That is the whole legal basis on which it is sold in the United States.
It is worth being precise about what it is not. It does not contain psilocybin. Psilocybin is a Schedule I controlled substance under federal law; Amanita muscaria is unscheduled. Conflating the two — which happens constantly, including in otherwise careful writing — makes a lawful product sound illegal and an illegal one sound lawful.
Federal status is not the whole story. In December 2024 the FDA stated that Amanita muscaria is not authorised for use in conventional food, which means edible formats sit in a regulatory grey area rather than having been affirmatively cleared. And Louisiana prohibits it outright.
Several states are drafting rules that would regulate it much as they regulate hemp-derived cannabinoids: age verification at 21, mandatory certificates of analysis, and packaging restrictions. We already do all three as a matter of policy, and we publish where each state stands.
